Whispair Terms

These Terms of Use (the “Terms”) govern your access to and use of the App and any related services provided by Radu Sterie (“we”, “us”, or “our”).You should also read our Privacy Policy , which explain how we process your personal data.


1. Who can use Whispair

1.1 Minimum age.
You may only use the App if you are at least 16 years old (or older if the law in your country requires a higher minimum age to use the App and for us to process your personal data).
If you are under 18, you may only use the App with the consent of a parent or legal guardian.1.2 Legal capacity.
By using the App, you represent that you have the legal capacity to enter into a binding agreement with us.
1.3 Account.
You must provide accurate and complete information when creating your account and keep it up to date. You are responsible for maintaining the confidentiality of your login details and for all activity under your account.


2. What Whispair is

Whispair is a voice-based social and messaging application that lets users:* Send short voice messages (“Whispers”) to a global channel for other users to randomly “catch”.
* Interact with Whispers (e.g., listen, like, “freeze”).
* Reveal limited profile information of other users in certain cases.
* Start and maintain 1-on-1, turn-based voice chats with other users.
* Unlock profile “chapters” over time as they exchange more messages.
* Participate in rankings, streaks, and daily prompts.
* View in-app ads and optionally purchase paid features (where available).
Features may be added, removed or changed at any time at our discretion, as described further in Section 13.


3. Key features & mechanics (non-exhaustive summary)

This is a high-level summary of how the App currently works. It is provided for convenience only and does not limit how we may change, update or remove features as described in Section 13.3.1 Global Whispers & time-to-live (TTL).* When you send a Whisper to the global channel, it will generally be available for a limited time (“TTL”) as shown in the App.
* Once the TTL expires, the Whisper becomes inaccessible to other users, except for those who have "frozen" it (see Section 3.5).
* We reserve the right to modify the default TTL at any time, including variations based on content type or feature.
3.2 Catching Whispers.* Whispers are surfaced to other users at random; you cannot control who catches your Whisper or whose Whisper you catch.
* We do not guarantee that any particular Whisper will be heard by any specific number of users (or at all).
3.3 Likes & extending lifetime.* When a user likes a Whisper, this may extend the Whisper’s TTL as indicated in the App at that time.
* We may change the amount of lifetime extension at any time or apply limits (e.g., maximum total lifetime).
3.4 Revealing the sender & starting chats.* By liking a Whisper, a user may be able to reveal the sender, which shows only the sender’s profile picture (no username or other details by default).
* After revealing the sender, the listener may be able to send a message request.
* A 1-on-1 chat starts only if the sender accepts and replies. The sender is not automatically available to everyone.
3.5 Freezing Whispers.* Users may have the option to “freeze” a Whisper so they can listen later and/or respond at another time.
* Frozen Whispers may appear in a dedicated section of the App.
* We may impose daily or overall limits on freezing.
3.6 Turn-based 1-on-1 voice chat.* Chats are voice-only; you send short audio messages instead of text.
* Chat is turn-based, meaning you can send a limited number of messages (e.g., 1 or 2) before needing a reply to send more.
* As you exchange more messages with someone, you can unlock additional benefits, such as sending more messages per turn.
3.7 Profiles & chapters.* Each user has a profile consisting of:* An introduction (profile picture, vibe “chips”, one-liner, username).
* Up to four chapters, each with photos, descriptions and optional prompt answers, which become increasingly more personal or intimate.
* By default, chapters are locked. They unlock gradually as you exchange more messages with a person. For example (numbers configurable in the App):
* Chapter 1: unlocks after a certain number of sent/received messages (e.g., 5/5) and may allow you to send more messages per turn.
* Chapters 2–4: unlock at higher thresholds (e.g., 15/15, 30/30, 50/50) with additional benefits determined in the App.
* If messages expire (see below) and the total falls below a threshold, previously unlocked chapters may become locked again.
3.8 Message TTL & chapter locking.* Messages in a chat may automatically expire after a certain period (e.g., 30 days), as displayed in the App.
* To keep chapters unlocked, you must maintain the required number of unexpired messages exchanged with that user.
3.9 Rankings, streaks & daily prompts.* We may rank individual Whispers based on their performance (e.g., the number of likes they receive). Any associated visual indicators or badges are cosmetic and for entertainment only.
* We may offer streaks that track how many days in a row you send a global Whisper, as well as streak saves if you miss a day.
* We may offer daily prompts that users can answer with their Whispers.
3.10 Limits, ads & paid features.* We may limit the number of global Whispers, likes, freezes or other actions you can perform per day.
* We may display ads in the App (for example, as cards between Whispers).
* We may offer paid features, such as:
* Transcriptions of audio;
* Filters for Whispers (by language, mood, country, etc.);
* Increased daily limits;
* Removal of ads;
* Other premium features described in the App.


4. Your content and your rights

4.1 User Content.
“User Content” includes any content you create, upload, record or otherwise provide through the App, such as:
* voice messages (Whispers, chat messages);
* profile photos and chapter photos;
* descriptions, prompts, and other profile information;
* any other material you make available through the App.
4.2 You retain ownership.
You retain all ownership rights in your User Content, subject to the license you grant us in these Terms.
4.3 License you grant us.
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to:
* host, store, reproduce, modify, adapt, translate, distribute, publicly perform and display that content;
* use it to operate, provide, improve, promote and protect the App;
* use it for moderation, safety, analytics and feature development, as described in our Privacy Policy.
For clarity: at this time, we do not use your User Content to train our own machine learning or AI models (see our Privacy Policy). If this changes in the future, we will update our policies and provide additional notice where required.This license continues for as long as we reasonably need it to provide the App and related services (including backups and legal obligations), even if your content is no longer visible in the App because its TTL has expired.4.4 Your responsibility for your content.
You are solely responsible for your User Content and for ensuring that you have all rights necessary to grant us this license and to share that content through the App.


5. Community rules

To keep Whispair safe, respectful and enjoyable, you agree that you will not:5.1 Illegal or harmful content.* Break any applicable law or regulation.
* Share content that is unlawful, fraudulent, defamatory, libelous or misleading.
* Share content that promotes self-harm, suicide, violence or dangerous activities.
5.2 Harassment and hate.* Harass, bully, threaten or stalk other users.
* Share content that is hateful, discriminatory or abusive towards any group or individual based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or similar characteristics.
5.3 Sexual and exploitative content.* Share sexually explicit or pornographic content.
* Share content involving minors in any sexualized or exploitative context (this is strictly prohibited).
* Attempt to solicit sexual images, audio or behaviour from minors, or misrepresent your age.
5.4 Privacy and personal data.* Share other people’s personal data without their consent (e.g., real name, address, phone number, workplace, social handles).
* Attempt to identify or dox other users from partial information (for example, from a profile photo or voice) and share that information.
5.5 Impersonation and deception.* Impersonate any person or entity or misrepresent your affiliation with someone.
* Use the App to scam, defraud, or deceive others, including romance scams, phishing or other fraudulent schemes.
5.6 Spam, bots & misuse.* Use automated tools or scripts to access, collect or interact with the App or its users.
* Send unsolicited or repetitive content, spam, or promotional material without our permission.
* Try to manipulate rankings, likes, streaks, freezes or other metrics (for example, by using multiple fake accounts).
5.7 Security and technical restrictions.* Attempt to hack, reverse engineer, decompile, or bypass any security or technical measures in the App.
* Interfere with the normal operation of the App, including by introducing viruses, malware, or denial-of-service attacks.
5.8 Emergency use.* Use the App for emergencies or urgent situations (e.g., medical, safety, law enforcement). The App is not designed for emergency communication.We may remove or restrict content, suspend or terminate accounts, or take other appropriate action where we believe these rules or the law have been violated.


6. Reporting & moderation

6.1 Reporting.
We provide tools for you to:
* report global Whispers; and
* report users you are chatting with 1-on-1.
You agree to use reporting tools honestly and not in an abusive or bad-faith manner.6.2 Our moderation rights.
We may, at our discretion:
* review reported content and accounts;
* remove, limit, or hide User Content;
* restrict certain features;
* suspend or terminate accounts;
* notify or cooperate with law enforcement or regulators where required by law or where we reasonably believe there is a risk of harm.
6.3 No obligation to monitor.
We are not obligated to monitor all content or behavior on the App and cannot guarantee that all harmful or violating content will be removed. However, we aim to act reasonably when we become aware of a violation.
6.4 Automated moderation.
Now or in the future, we may use automated systems (including AI) to help detect and moderate content and behavior (for example, detecting spam, harmful or illegal content). These systems may sometimes make mistakes, and you can use the reporting features to challenge or appeal certain actions, where available.


7. Virtual features, limits & rankings

7.1 Virtual features.
The App may offer virtual features or benefits—such as Whispers, likes, freezes, streaks, streak saves, ranks, badges, or chapter unlocks. These:
* have no real-world monetary value;
* are part of the entertainment experience of the App;
* do not represent any property or ownership right outside the App.
7.2 Changes to limits and mechanics.
We may at any time:
* change how many Whispers, likes, freezes or other actions you can use per day;
* modify how ranks and badges are calculated;
* adjust message and Whisper TTLs;
* modify thresholds for chapter unlocking.
7.3 No guaranteed outcomes.
We do not guarantee that:
* you will receive any particular rank or badge;
* your content will be liked, frozen or listened to;
* any particular user will see your content or respond to your messages.


8. Paid features & purchases

8.1 In-app purchases.
The App may offer paid features or subscriptions (“Paid Features”), which may include, for example:
* transcription services;
* filtering of Whispers by language, mood, country, or other criteria;
* increased daily limits for certain actions;
* removal of ads;
* other premium functionality as described in the App.
8.2 Payment processing.
Payments are typically processed via the relevant app store (e.g., Apple App Store, Google Play Store). Their terms and policies apply in addition to these Terms.
8.3 No cash value & no refunds (subject to local law).* Paid Features do not have cash value and are non-transferable.
* Except where required by applicable law or the app store’s own policies, all purchases are final and non-refundable.
* If your account is suspended or terminated for violating these Terms, you may lose access to Paid Features without a refund.
8.4 Auto-renewing subscriptions.
If you purchase a subscription:
* it may renew automatically at the end of each billing period;
* you can manage or cancel your subscription via your app store account settings;
* cancellation typically takes effect at the end of your current billing period (you will usually retain access until then).
Please review the details for any Paid Feature in the App and in the app store before purchasing.


9. Intellectual property & our rights

9.1 Our content.
The App, including its design, logo, trademarks, text, visuals, sounds (other than User Content), code and other materials is owned by us or our licensors and is protected by copyright, trademark and other laws.
9.2 License to use the App.
We grant you a personal, limited, revocable, non-exclusive, non-transferable license to download and use the App for your own personal, non-commercial use, subject to these Terms.
9.3 No other rights.
Except as explicitly allowed in these Terms, you may not copy, modify, distribute, sell, lease, or create derivative works based on the App or any part of it.


10. Third-party services & ads

10.1 Third-party content.
The App may show ads, links or content from third parties. We do not endorse or control these third-party services and are not responsible for their content, accuracy, policies or practices.
10.2 Your dealings with third parties.
Any interactions with third parties (including advertisers) are solely between you and that third party. You should review their own terms and privacy policies.
10.3 Crash reporting and diagnostics.
We may use third-party services to help us diagnose and fix crashes and other technical issues (for example, crash reporting tools). These services may collect technical information about your device and the App’s operation. See our Privacy Policy for details.


11. Disclaimers

11.1 As-is and as-available.
The App is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11.2 No guarantee of availability.
We do not guarantee that the App will always be available, secure, or free from errors, bugs, or interruptions.
11.3 No responsibility for user behavior.
We are not responsible for the conduct, actions or content of any user or third party, on or off the App. You may be exposed to content you find offensive, inaccurate or inappropriate. You agree that you use the App at your own risk.
11.4 No professional advice.
Content on the App is user-generated and for entertainment and social interaction only. It does not constitute professional advice (including but not limited to medical, legal, mental health or financial advice).


12. Limitation of liability

To the maximum extent permitted by applicable law:12.1 We (and our directors, employees, partners, and affiliates) will not be liable for:* any indirect, incidental, consequential, special or punitive damages;
* loss of profits, revenues, data, goodwill or reputation;
* any loss or damage resulting from:
* your access to or use of, or inability to access or use, the App;
* any conduct or content of other users or third parties;
* unauthorized access to or use of your account or data.
12.2 Our total liability for any claims arising out of or relating to the App or these Terms will be limited to:* the amount you have paid us (if any) for Paid Features in the 12 months immediately before the event giving rise to the claim; or
* if you have not paid us, €50 (or equivalent in local currency).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In that case, we will be liable only to the minimum extent required by applicable law.


13. Changes to the App and these Terms

13.1 Changes to features.
We may add, remove or modify features of the App at any time. We may also introduce new Paid Features or change the terms of existing ones, subject to applicable law.
13.2 Changes to these Terms.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top and may provide additional notice (for example, in-App notifications).
13.3 Your continued use.
If you continue to use the App after changes to these Terms take effect, you are deemed to have accepted the updated Terms. If you do not agree to the changes, you must stop using the App and may delete your account.


14. Suspension and termination

14.1 Your right to stop using the App.
You may stop using the App and, where available, delete your account at any time through the settings. When you delete your account, we will delete or anonymise personal data associated with it within a reasonable period, subject to our retention practices and any legal, safety, security, fraud prevention, and backup needs, as described in our Privacy Policy.
14.2 Our right to suspend or terminate.
We may suspend or terminate your account or access to the App (or parts of it) if:
* we reasonably believe you have violated these Terms or any applicable law;
* we are required to do so by law, court order, or regulator;
* we decide to discontinue the App, in whole or in part.
14.3 Effect of termination.
Upon termination:
* your right to use the App will end;
* some or all of your User Content may be deleted, hidden, or kept only as long as we reasonably need it for legitimate purposes (e.g., legal, security, backup), in line with our Privacy Policy;
* you may lose access to Paid Features without any refund, except where required by law.


15. Governing law & dispute resolution

15.1 Governing law.
These Terms and any dispute or claim arising out of or in connection with them or the App will be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles.
15.2 Jurisdiction.
You agree that the courts of Amsterdam, the Netherlands will have exclusive jurisdiction over any dispute or claim arising from or related to these Terms or the App, unless mandatory law grants you the right to bring claims in your local courts.
15.3 Consumers in the EU/EEA/UK.
If you are a consumer residing in the EU/EEA/UK, you may have certain mandatory rights to bring claims in the courts of your place of residence and to rely on the mandatory consumer protection laws of that country. Nothing in these Terms limits those rights.


16. Miscellaneous

16.1 Entire agreement.
These Terms, together with the Privacy Policy and Cookies Policy, form the entire agreement between you and us regarding the App and supersede any prior agreements.
16.2 Severability.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
16.3 No waiver.
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
16.4 Assignment.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations without restriction, including in connection with a merger, acquisition or sale of assets.

17. Language
